Terms of Service

By accessing or using UpaayaX — whether as a Service Seeker, Service Provider, or visitor — you agree to be bound by these Terms of Service. If you do not agree, please discontinue use immediately.

You must be at least 18 years of age and legally capable of entering into binding contracts under the laws of Nepal to use UpaayaX. By using the platform, you confirm you meet these requirements.

UpaayaX reserves the right to update these Terms at any time. We will notify registered users via email 14 days before changes take effect. Continued use of the platform constitutes acceptance of revised Terms.

You must provide accurate, complete, and current information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

UpaayaX offers three account types: Service Seeker, Service Provider, and Admin. Each role has distinct permissions and responsibilities. Misrepresenting your role or creating multiple accounts is strictly prohibited.

You agree not to impersonate others, post false information, harass other users, attempt to gain unauthorized access, or use automated tools to scrape or interact with the platform.

Service Providers must complete UpaayaX's identity and credential verification process. Submitting false or forged documents will result in permanent account termination and may be reported to authorities.

Providers are responsible for ensuring their listed services, rates, descriptions, availability, and service areas are accurate and up to date. Misleading listings are subject to removal without notice.

Providers agree to deliver services professionally, on time, and in accordance with the agreed scope. Repeated cancellations, poor ratings, or complaints may result in listing suspension or account removal.

All bookings are confirmed only upon successful payment. Seekers must provide accurate service location details. UpaayaX is not responsible for service failures arising from incorrect information provided by the Seeker.

UpaayaX processes payments via Khalti and eSewa. All transactions are subject to the terms and conditions of the respective payment provider. UpaayaX does not store full payment credentials.

Cancellations made more than 24 hours before the scheduled service may be eligible for a full refund. Cancellations within 24 hours are subject to a cancellation fee as outlined in our Refund Policy.

Users may not use UpaayaX for illegal services, money laundering, fraud, harassment, or to bypass the platform for off-platform transactions. Any attempt to circumvent fees by arranging direct payments is a violation.

All content submitted — including service descriptions, reviews, and profile information — must be truthful, respectful, and free of hate speech, explicit material, or defamatory statements.

Reviews must reflect genuine first-hand experiences. Fake reviews, review manipulation, or coercing users into positive feedback violates our guidelines and may result in account suspension.

UpaayaX is a marketplace platform that connects Seekers with independent Service Providers. We do not directly employ Service Providers and are not liable for the quality, safety, or legality of services rendered.

In the event of a dispute between a Seeker and Provider, UpaayaX may, at its discretion, assist with mediation. However, we are not obligated to resolve disputes and our decision in any mediation is final.

To the maximum extent permitted by Nepalese law, UpaayaX's total liability for any claim arising from use of the platform shall not exceed the total amount you paid to UpaayaX in the 3 months prior to the claim.

You may terminate your account at any time through your account settings or by contacting support. Upon termination, your right to use the platform ceases immediately.

We reserve the right to suspend or permanently terminate your account without notice if you violate these Terms, engage in fraudulent activity, or if we determine your presence poses risk to our platform or users.

Upon termination, any pending bookings will be handled as per our cancellation policy. Outstanding payments owed to Service Providers will still be processed. Provisions that should survive termination by nature will do so.

These Terms are governed by and construed in accordance with the laws of Nepal. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Nepal.

Before initiating legal proceedings, both parties agree to attempt good-faith resolution through direct negotiation. If unresolved within 30 days, disputes may be referred to arbitration per Nepalese arbitration law.

You agree that any dispute resolution proceedings will be conducted on an individual basis only. You waive any right to participate in class action lawsuits or class-wide arbitration against UpaayaX.
